Proposed Law May Affect Facebook IPO – Legislation was introduced in the Senate this week that could result in the delay of Facebook’s IPO. A long-standing finance rule requires that companies with 500 or more shareholders make their finances available to the public (typically prompting companies to also make their stock available to the public). Facebook had accumulated many shareholders from distributing stock to employees and from its shares being bought and sold on private exchanges. The new rule would up the minimum threshold to 2000, presumably giving Facebook more leeway to decide if and when it will make its financial information and its shares public.

Could Yahoo’s Patents Hurt Facebook’s IPO? – Forbes has a piece this week that compared Yahoo’s extensive IP portfolio as potential revenue to Facebook’s ads-centric revenue approach, speculating that whoever owns that IP could charge licensing fees to Facebook.

Facebook Not Planning Taiwan Data Center – Facebook is not set to open Asia’s largest cloud data center in Taiwan, at the Central Taiwan Science Park, contrary to a widely republished article.

Facebook Opens Preferred Developer Consultant Fall 2011 Submissions

Facebook has just begun the application process for selecting the next batch of Preferred Developer Consultants. It began accepting permissions yesterday and will close at 5 p.m. PST December 6.

Facebook created the PDC to list trusted providers for Facebook-related services in application development, Pages, campaigns and other social experiences for companies, brands and celebrities. PDCs have a long history of providing Facebook development tools, most from the early days of Facebook. The initial list started in December 2009, and there are currently 90 PDCs with about 170 offices worldwide, 67 outside the United States. The last round of submissions was in May, when Facebook added 25 developers to the PDC Directory.

Facebook also says that organizationally PDCs will be brought together with Ads API partners to form a single Facebook Marketing API Program. It is actively encouraging all service provider companies to broaden their range of offerings for the various needs of those using the platform. “Our long-term goal is to support development companies that can provide integrated and holistic Platform, Pages, and Ads solutions to Facebook marketing and business operations,” program manager Matt Trainer says in the blog post about the new round.

PDCs can be found based on location and expertise, and Facebook provides a mapping application on its Platform page, PDC Lookup, added in 2010.

Walmart Goes Local on Facebook, Seeking Shopper Adoption

Just in time for coveted Black Friday discounts, Walmart and Facebook have partnered release My Local Walmart, a move to connect Fans of the world’s largest retailer with neighborhood deals, product rollbacks and in-store events through the News Feed.

“A national message is not always relevant,” Stephen Quinn, Wal-Mart’s senior vice president and chief marketing officer, told several news sources. “We can now say we have sunscreen in the south and snow boots in the north.”

With more than 10 million fans, according to PageData, Walmart’s move to store-level messaging gives shoppers the information that’s most useful—nearby deals. Earlier this week, we noted that Walmart had gained 51,460 followers, moving the Page to one of the most popular of the week, according to our Top 20 report on PageData. More than 3,500 Wal-Mart local pages have already launched on Facebook, through the My Local Walmart application. Users type in their zip code, and a populated screen of local stores shows up, with the option to like any number of them. Already equipped with the Black Friday discount previews to help families organize their holiday shopping and find nearby discounts. ‘Liking’ a local Walmart store also enables users to check out a downloadable map pinpointing the location of the store and key special deals.

While there is significant buzz, don’t expect Walmart shoppers to use Facebook as the go-to place for its retail information yet. When we roamed for local listings near San Francisco, none of the options had yet to receive more than 50 ‘likes.’ As Henry Kim of sneakpeeqtold Forbes, “they have to put a lot of resources into it and continue to figure out what works and iterate just like any other social commerce player.” While Walmart is a behemoth brand, that doesn’t mean it’ll get immediate success out of its its locally-powered app. Since Walmart no longer will be speaking from just one major megaphone, we’ll see how often local Walmart chains update deals, and events. According to Quinn, Walmart expects the local Walmart Pages to send two updates per day.

For Walmart, it’s a move to get to know the shoppers better as well, gain key information on what items to stock, and of course, start monetizing on those Page ‘Likes.’ Walmart’s overall margins have been down, although it reported a 5.7 percent second-quarter earnings, reported The Wall Street Journal. This new partnership is also a move to compete with Amazon in e-commerce and social networking. Amazon launched several partnership components with Facebook in 2010. And like Amazon, Walmart still has a significant amount of testing to do.

Horoscopes, Gifts, Page Tabs, Photos, LMFAO and “Twilight” on This Week’s Top 20 Emerging Facebook Apps by MAU

There were quite a bit of applications on our list this week that included publishing virtual gifts to others’ Walls. Then there were Page tabs, photo apps, and a variety of other apps.

The apps on our list grew from between 130,000 and 500,000 MAU, based on AppData, our data tracking service covering traffic growth for apps on Facebook. We define emerging applications as those that ended with between 100,000 and 1 million MAU in the past week.

عيد على صحابك is an app that grew by 500,000 MAU; the app posts virtual gifts to the Wall of a user’s friends. Then Rock You’s Horoscopes app grew by 420,000 MAU, also asking users to post daily Wall posts. Mystic Meg grew by 260,000 MAU and publishes a fortune to the Wall of the user. Greeting Cards grew by 160,000 MAU; it’s a Connect website that shows a user’s friends and enables them to send birthday greeting cards. Dostlar Birbirini Anımsasın… grew by 130,000 MAU and generates a half dozen feed stories when used.

Page tabs were IFrame tabs with 330,000 MAU and SocialTimes iFrames Wizard with 310,000 MAU. Photo apps included My Photos with 200,000 MAU, My Photos+ with 190,000 MAU and Le Mie Foto with 180,000 MAU. These apps present users with a photo gallery of their friends’ photos, allowing them to Like or save them. Liking them publishes a feed story. Finally, Photo Roll grew by 150,000 MAU and presents users with a photo gallery of their friends’ photos, allowing them to Like or save them.

The rest of the list was varied. Chat Pro by mSonar grew by 230,000 MAU. Auto Collect Games Bonuses grew by 210,000 MAU and allows you to see all your game bonuses in one interface and then collect them at once. Amazon Sweepstakes grew by 180,000 MAU, online file backup app Dropbox grew by 170,000 MAU and the trailer/showtimes/ticket/photo upload app for Breaking Dawn – Part 1 grew by 160,000 MAU.

Then there was email marketing app AWeber Email Marketing with 150,000 MAU, Facebook’s Credits Store Locator with 150,000 MAU and LMFAO’s Are You A Party Rocker? with 140,000 MAU.

Report: Facebook to Settle FTC Case by Making Privacy Changes Opt-In

Facebook is close to settling charges by the Federal Trade Commission that it deceived users about privacy changes, The Wall Street Journal reports. The settlement would “require Facebook to obtain ‘express affirmative consent’ when it makes ‘material retroactive changes’” to private user data. In other words, sharing-related privacy changes will now be up to users to opt into — Facebook won’t be able to force people to either make more data available, or have to “opt out” of using Facebook.

The specific issue is that Facebook changed its privacy policies in late 2009, forcing all users to make some information public that it had previously said would not be made public. Until that point, Facebook’s policy had said that “you choose what information you put in your profile, including contact and personal information, pictures, interests and groups you join. And you control the users with whom you share that information through the privacy settings on the Privacy page.”

That November, it announced that some of this information – profile name, profile picture, list of friends, current city, gender, networks, and Pages — would be made public as part of a privacy policy change. And it was, that December, causing an outcry among some users and privacy advocates, and getting the FTC’s attention.

While both the November policy change and December product update stated what the changes were, many users still didn’t comprehend what was going on — especially because Facebook had not previously told them to expect such changes. Further issues, like Facebook making all Liked Pages public in April of 2010, or more recently offering a face-targeting service, have added to the perception among some that Facebook is not prioritizing privacy.

The settlement, which Facebook isn’t commenting on right now, appears to create new limits around what Facebook might launch in the future. It would be precluded from doing anything like that December 2009 product change, for example. In addition, Facebook will be subject to independent privacy audits for the next 20 years, although it’s currently unclear who the auditors would be or how they would hold Facebook accountable.

Facebook’s side of this story is that it has needed to revisit out the right balance of public/private as its service has evolved, and as cultural expectations around privacy have changed. When the company first launched on college campuses, the whole point was to offer a private community. Today, some use the site for sharing content more publicly.

If the FTC had acted earlier, maybe it would have precluded Facebook from creating more value for users (a key risk that the company created for itself due to its decisions). For example, if some large portion of users had chosen not to make their profile photos and names public, Facebook’s social plugins would be able to show significantly less relevant social information to other users.

But at this point, Facebook appears to have gotten its main privacy changes completed, and we’re left wondering what the FTC will have left to enforce.

Crowd Science’s Facebook Study: People Most Often Click Like to Show Support and Enjoyment

“Like us on Facebook!” is a common Facebook marketing catch-phrase, but it’s not getting the biggest reaction among users, according to a new study by social analytics company Crowd Science out this week.

Facebook brand Pages have been Liked by only nine percent of the users surveyed. Instead, the most popular reasons users Liked a Facebook page were “because I wanted to show my support” or “enjoyed what was being said or shown.” Which makes sense. People naturally want to show what they care about as part of their identity on Facebook, just like they do in the rest of their lives.

Along with the relatively low interest in Liking brand Pages, only six percent of those surveyed Liked Facebook pages for deals and sweepstakes.

As the age of the user increases, the interest in keeping abreast of product offers and company activity decreases, according to the study. Only one percent of respondents 65-years or older were reported to have Liked brand items to keep informed about the brands.

But no single type of Facebook feature has attracted ’likes‘ by more than 20 percent of all Facebook user activity, according to the survey respondents in the study. Wall posts, pictures and comments led the ’likes‘ list, each having been Liked by 16 percent of respondents, consistent across all age and gender groups.Those who have Liked marketers Pages skew younger, according to the sample of 1,224 random respondents gathered in June 2011. When we asked whether older users, 65 and older, were commenting instead of Liking, they didn’t have this information. With the upcoming Timeline layout, we’ll see if the more aesthetically engaging interface encourage more likes, or if the Liked button is just not a natural click for users.
